These Terms govern your access to and use of byteshift.in (the “Site”) and any services provided by ByteShift (“we,” “us,” “our”). By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.
1. Use of the website
You may browse the Site for personal or business research purposes related to engaging our services. You agree not to:
- Use the Site for any unlawful purpose or in violation of these Terms
- Attempt to gain unauthorized access to any portion of the Site
- Interfere with the Site's operation, security, or other users' use
- Use automated tools (bots, scrapers) to extract content without our permission
- Reproduce, modify, or distribute Site content except as expressly permitted
2. Intellectual property
All content on the Site — including text, graphics, logos, code, design, and the ByteShift name and brand — is owned by ByteShift or its licensors and is protected by intellectual property laws. You may not use any of this content without our prior written consent, except for fair-use purposes such as quoting brief excerpts with attribution.
Client work showcased on the Site is presented with the respective clients' permission. We retain the right to display work in our portfolio unless otherwise agreed in writing.
3. Services
The Site is a marketing presence; engaging us for design, development, or related services creates a separate contractual relationship governed by a written proposal or service agreement signed between you and ByteShift. Nothing on the Site constitutes a binding offer of services until such an agreement is executed.
4. Third-party links and services
The Site may include links to third-party websites or rely on third-party services (such as Google Calendar, Vercel, or reCAPTCHA). We do not control these third parties and are not responsible for their content, policies, or practices. Use of third-party services is governed by their respective terms.
5. Disclaimer of warranties
The Site is provided on an “as is” and “as available” basis without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components.
6. Limitation of liability
To the fullest extent permitted by law, ByteShift, its team, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, data, or goodwill — arising out of or in connection with your use of the Site, even if we have been advised of the possibility of such damages. Our total aggregate liability for any claim arising out of or relating to the Site shall not exceed INR 1,000.
7. Indemnification
You agree to indemnify and hold ByteShift harmless from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your misuse of the Site or violation of these Terms.
8. Modifications
We may modify these Terms at any time. Material changes will be reflected by updating the “Last updated” date. Continued use of the Site after changes constitutes acceptance of the revised Terms.
9. Governing law and jurisdiction
These Terms are governed by and construed in accordance with the laws of India. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Kerala, India.
10. Severability
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
